These Terms of Service (the “Terms”) govern your access to and use of BookMyLib’s websites, applications, and related services (the “Service”). By accessing or using the Service, you agree to these Terms.

1. About these Terms

These Terms form a legally binding agreement between you and StudySpot India Pvt. Ltd. (operating the BookMyLib platform). You must be able to enter into a binding contract under applicable law to use the Service.

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Definitions

  • “BookMyLib”, “we”, “us” refers to StudySpot India Pvt. Ltd. and the BookMyLib platform.
  • “Service” includes our website, apps, dashboards, APIs, and related features (including booking, subscriptions, attendance, and support).
  • “Library”, “Branch” refers to third-party libraries/study spaces that list seats/plans and provide on-ground facilities and services.
  • “User”, “you” refers to any person using the Service, including Students, Staff, and Owners.
  • “Student” means a user who browses branches, books plans, and uses the on-ground services.
  • “Owner” means a library operator who manages branches, plans, staff, pricing, policies, and dashboards.
  • “Staff” means an authorised user managed by an Owner to operate parts of a branch (for example attendance, finance, or student management).
  • “Booking/Subscription” refers to a seat/locker plan purchase or reservation created through the Service.
  • “Content” means text, photos, documents, and other materials uploaded or shared through the Service.

3. Eligibility

  • You must provide accurate information and keep it updated.
  • You must comply with applicable laws and branch rules when using the Service.
  • If you do not meet eligibility requirements, we may restrict or terminate access.

4. Accounts & security

  • You are responsible for safeguarding your credentials and any activity under your account.
  • You must promptly notify us of unauthorised access or security incidents via /contact.
  • We may require verification to protect users and to prevent fraud (for example, for sensitive actions or payments marked for verification).

5. Platform role & third-party libraries

BookMyLib helps users discover branches, view plans, and manage bookings/subscriptions. Libraries/branches are independent third parties responsible for their on-ground services, facilities, availability, staff conduct, safety, compliance obligations, and branch rules.

To the extent permitted by law, BookMyLib is not responsible for events that occur at a branch premises or for the quality/availability of on-ground services provided by a branch.

6. Bookings, subscriptions, attendance & branch rules

  • Plan details (pricing, duration, amenities, included items) are listed by libraries and may vary by branch.
  • Branch rules (timings, entry conditions, seat/locker policies, behaviour guidelines) apply to your use of that branch.
  • Attendance features (including QR check-in/out) are operational tools and may require staff verification depending on branch settings and policy.
  • You agree not to misuse seats/lockers, share access improperly, or attempt to bypass branch restrictions.

7. Owners & staff terms

If you are an Owner or Staff, you agree that you will use the Service only for lawful branch operations, and you are responsible for your actions, your users, and your configuration choices (including branch policies, permissions, and pricing).

  • Accuracy: You will provide accurate plan and branch information and keep it updated.
  • Permissions: You will assign staff access responsibly and maintain appropriate controls for sensitive modules (for example finance).
  • Compliance: You will comply with applicable laws, including consumer protection, taxation, and any other obligations applicable to your business.
  • Student experience: On-ground services, availability, facilities, and conduct are your responsibility at the branch level.

8. Payments, billing & taxes

  • Payments may be processed through third-party payment gateways. Gateway availability and processing times may vary.
  • You authorise us (and/or our payment partners) to charge the payment method you provide for purchases, renewals, or fees you select.
  • Taxes, gateway fees, or convenience fees (if applicable) may be added and shown at checkout.
  • For some payment methods, a payment may be marked as pending until verification is complete.

9. Refunds, cancellations & chargebacks

Refund and cancellation decisions may depend on plan type, consumption/usage, verification of your request, and branch policy. To request a refund or cancellation, submit a request using our refund flow.

If you initiate a chargeback/dispute with your bank or payment provider, we may suspend access to parts of the Service while the dispute is reviewed and may request additional information to investigate the transaction.

10. Promotions, referral & coupons

  • Promotions may be public or private. Private promotions may be redeemable only via a code and may not appear in public listings.
  • Promotions may have restrictions such as validity dates, minimum order value, maximum discount amount, and stacking rules.
  • We may modify or discontinue promotions at any time, subject to applicable law and any specific terms shown for that promotion.

11. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, abusive, or deceptive purposes.
  • Attempt to bypass security controls, access other accounts, or scrape data.
  • Reverse engineer, interfere with, or disrupt the Service or its infrastructure.
  • Upload malware or use the Service to distribute malicious code.
  • Misrepresent your identity or affiliation.
  • Use automated means to access the Service in a way that burdens the platform.

12. User content, uploads & feedback

You may upload or submit content to the Service (for example proof of payment, verification documents where applicable, or support messages). You represent that you have the rights to submit such content and that it does not violate any law or third-party rights.

If you provide suggestions or feedback, you agree we may use it without restriction or obligation to you.

13. Intellectual property

The Service, including branding, design, text, and software, is owned by BookMyLib or its licensors and is protected by applicable laws. You may not copy, modify, or distribute any part of the Service without prior written permission.

14. Third-party services & links

The Service may integrate with or link to third-party services (for example payment providers, external informational links, or Google APIs). We do not control and are not responsible for third-party services. Your use of third-party services is subject to their terms and policies.

Google API Integrations & Scopes: If you connect a Google account to the Platform (for instance, to manage your Google Business Profile locations, sync contacts, or send emails via the Gmail API), you grant BookMyLib authorization to interact with those APIs on your behalf. You agree that:

  • You are solely responsible for ensuring your Google account is in good standing and that you comply with Google’s own terms of service.
  • Any transactional or promotional content you distribute via our Gmail integration must comply with local laws (such as CAN-SPAM, GDPR, or other privacy frameworks). You agree not to distribute spam or unauthorized communications.
  • We are not responsible for any rate-limiting, account suspensions, or data modifications initiated on your third-party Google profiles by Google.

16. Disclaimers

The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation, or that all branch information will always be accurate or available.

Branch services are provided by third-party libraries/branches. BookMyLib does not provide the on-ground study space service and does not make warranties regarding the branch’s facilities, safety, or suitability for your needs.

17. Limitation of liability

To the maximum extent permitted by law, BookMyLib will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service or a branch’s on-ground services.

18. Indemnity

You agree to defend, indemnify, and hold BookMyLib harmless from claims arising out of your misuse of the Service, violation of these Terms, or infringement of rights.

19. Suspension & termination

  • We may update, suspend, or discontinue the Service (or any part) at any time.
  • We may suspend or terminate accounts for suspected fraud, abuse, security risk, or violations of these Terms.
  • Some sections of these Terms will survive termination, including intellectual property, disclaimers, limitation of liability, and indemnity.

20. Governing law & jurisdiction

These Terms are governed by the laws of India. Courts located in New Delhi shall have jurisdiction, subject to applicable law.

21. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date and, where appropriate, provide additional notice.
